New Ethics Opinion Released

Can a lawyer ethically make statements to the news media: (1) criticizing an opponent’s litigation tactics and (2) restating allegations from the underlying complaint while the case is pending on appeal?
Under the facts presented, the Professional Ethics Committee for the State Bar of Texas says yes, pointing specifically to the “timing of the statements” to conclude that they would not have “a reasonable likelihood” of materially prejudicing a future jury trial.
